Nintendo wins lawsuit against another piracy website in French Court

Nintendo secures another legal victory against a sharehosting website distributing pirated games. They call court decision as a win for the entire games industry.

Nintendo is known to protect its IP very extensively and recently announced another victory against a French hosting website failing to remove pirated Nintendo games. The decision came from a French court which ruled Dstorage, the operator of the sharehosting site ‘1fichier’ guilty. Nintendo says it is pleased with the court ruling.

This victory came following a long battle against the platform as back in 2021, Dstorage was ordered to pay €935k in damages to Nintendo by the Judicial Court of Paris. The host platform escalated the case by filing an appeal which also did not work out as the court once again asked the hosting site to pay €442k to Nintendo along with €27,000 to cover legal expenses.

Dstorage, however, thought the third time would be its charm and reached the highest French judiciary court which Nintendo recently won putting an end to the case. This also resulted in the court ruling that any sharehosting providers across Europe must remove pirated content as soon as it's requested.

A win for entire games industry Nintendo says

Nintendo considered this long-fought battle against Dstorage as a win for the entire industry as video game piracy is quite popular. “Nintendo is pleased with the Court’s finding of liability against Dstorage and believes that it is significant not only for Nintendo but for the entire games industry,” Nintendo said in its statement.

“It will prevent sharehosters like 1fichier.com from claiming like it did during the proceedings on the merits that a prior decision from a court is needed before pirated content must be taken down, and it confirms the rights that holders have to give notice of when claiming that notified content infringes copyright or trademark rights,” the company further added.

Not the first rodeo for Nintendo

Gamers are well aware of Nintendo and all the lawsuits the company has won in the past. Last year, the company won a lawsuit against the creator of the Yuzu emulator which subsequently led to its shutdown. Another Switch emulator ‘Ryujinx’ was also shut down after the creator reportedly agreed to a deal with Nintendo.

Nintendo
